By accessing or using our website (indusability.com.au) or submitting an enquiry to Indus Ability Pty Ltd (ABN 00 000 000 000) (Indus Ability, we, us, our), you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
If you accept these Terms on behalf of another person (such as an NDIS participant, nominee or organisation), you represent that you have authority to bind that person or organisation.
2. About Indus Ability
Indus Ability is a registered NDIS Specialist Disability Accommodation (SDA) provider delivering purpose-built accessible housing for NDIS participants across Australia. We are registered with the NDIS Quality and Safeguards Commission and operate in accordance with applicable NDIS legislation, rules and practice standards.

3. Website use
You may use our website for lawful purposes only. You must not:
- use the website in any way that breaches applicable laws or regulations;
- attempt to gain unauthorised access to our systems, data or networks;
- introduce viruses, malware or other harmful code;
- scrape, harvest or systematically copy content without our written consent;
- misrepresent your identity, NDIS status or authority to act on behalf of another person;
- use our AI chat assistant to generate unlawful, abusive or misleading content.
We may suspend or restrict access to the website for maintenance, security or operational reasons without notice.
4. Information & advice
Content on this website — including articles, guides, FAQs, property descriptions and AI chat responses — is provided for general information only. It does not constitute:
- NDIS, financial, legal or medical advice;
- a guarantee of SDA funding approval or housing availability;
- a binding offer to provide accommodation; or
- professional advice from an occupational therapist, support coordinator or planner.
You should seek independent advice from qualified professionals and confirm details with the NDIA before making decisions about SDA funding or housing. Property images, specifications and availability may change without notice.
5. Enquiries & applications
When you submit an enquiry, referral or expression of interest:
- you warrant that information provided is accurate and complete to the best of your knowledge;
- you consent to us contacting you about SDA housing and related services;
- submission does not create a tenancy, reservation or guarantee of a property;
- we may request additional information (including NDIS plan details or OT reports) to assess suitability; and
- we may decline or defer an application where a property is unsuitable, unavailable or funding is not confirmed.
Referrals from support coordinators should include appropriate participant consent or authority as required by the Privacy Act 1988 (Cth) and NDIS requirements.
6. SDA services & agreements
Provision of SDA housing is governed by separate written agreements (such as tenancy agreements, SDA provider agreements and participant service agreements) that will be provided before you enter into a binding arrangement with us.
In the event of inconsistency between these Terms and a signed agreement relating to SDA housing, the signed agreement prevails to the extent of the inconsistency.
We comply with the NDIS Code of Conduct and applicable SDA provider obligations, including in relation to participant rights, dignity of risk and complaint handling.
7. Fees & NDIS funding
SDA pricing is set by the NDIA under the NDIS Price Guide and SDA Pricing Arrangements. Participants may be required to pay a reasonable rent contribution in accordance with NDIS rules and their individual circumstances.
We will provide clear information about SDA pricing, inclusions and any participant contributions before you enter a formal agreement. We do not charge fees for general website enquiries unless expressly disclosed and agreed in writing.
8. Intellectual property
All content on this website — including text, images, logos, floor plans, designs, videos and software — is owned by or licensed to Indus Ability and protected by Australian copyright, trade mark and other intellectual property laws.
You may view and print pages for personal, non-commercial use. You must not reproduce, modify, distribute or exploit our content without prior written consent, except as permitted by law.
The Indus Ability name and logo are trade marks of Indus Ability Pty Ltd. Unauthorised use is prohibited.
9. Third-party links & services
Our website may contain links to third-party websites (such as the NDIA, NDIS Commission, Google Maps or social media platforms). We do not control and are not responsible for the content, privacy practices or availability of third-party sites.
Form submissions may be processed by third-party email delivery services to transmit your enquiry to our team. Those providers are required to handle information in accordance with our Privacy Policy.
10. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) (ACL).
Where you acquire services from us as a consumer within the meaning of the ACL, you are entitled to remedies for failure to comply with a consumer guarantee. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be lawfully excluded.
For services not covered by the ACL (for example, where you acquire services in trade or commerce and not as a consumer), the limitations in section 11 may apply to the fullest extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law (and subject to section 10):
- the website and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied;
- we do not warrant that the website will be uninterrupted, error-free or free from viruses or other harmful components;
- we are not liable for any loss or damage arising from reliance on website content, AI chat responses, property listings or third-party links; and
- our total liability to you for any claim arising from or related to your use of the website (other than under non-excludable ACL guarantees) is limited to the resupply of the relevant services or, at our option, the cost of resupplying those services.
Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.
12. Indemnity
You agree to indemnify and hold harmless Indus Ability, its directors, employees and agents from any claim, loss or expense (including reasonable legal costs) arising from your breach of these Terms, misuse of the website, or provision of false or misleading information — except to the extent caused by our negligence or wilful misconduct.
13. Privacy
Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms. By using our website, you consent to the collection and use of information as described in the Privacy Policy.
14. Suspension & termination
We may suspend or terminate your access to the website or refuse to process enquiries if we reasonably believe you have breached these Terms, engaged in unlawful conduct, or posed a risk to our staff, participants or systems.
Termination of website access does not affect existing SDA agreements or our obligations under applicable law.
15. Governing law & disputes
These Terms are governed by the laws of the State of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia.
Before commencing legal proceedings, we encourage you to contact us to attempt to resolve disputes in good faith. NDIS participants may also use the NDIS complaints process through the NDIS Quality and Safeguards Commission.
If any provision of these Terms is invalid or unenforceable, the remaining provisions continue in full force.
16. Changes to Terms
We may update these Terms from time to time. The current version will be published on this page with an updated Last updated date. Your continued use of the website after changes are posted constitutes acceptance of the revised Terms. For material changes, we may provide additional notice where appropriate.
